If a legacy MIDI application sends a bank select (MSB, LSB or both) (CC0 / 32) but not a program change after that , should the OS send the bank select to the UMP device ?

Yes it is. Either way, from and to legacy/UMP device/virtual connections

Not sure , but could this be an issue for apps or device that use CC 0 and 32 in such as way without using program changes. it will never get a CC 0 or 32.
